Trump Cabinet Warns Court of Diplomatic Crisis if Tariffs Ruled Illegal
On August 29, Eastern Time, foreign media reported that Trump administration officials warned the U.S. Federal Circuit Court of Appeals that declaring Trump's global tariffs illegal would severely damage American foreign policy. Treasury Secretary Besent cautioned that such a decision would bring "dangerous diplomatic embarrassment." The White House submitted statements from Besent, Commerce Secretary Lutenick, and Secretary of State Rubio to the court in Washington. The court is expected to soon rule on whether Trump exceeded his authority to impose tariffs under the 1977 Emergency Powers Act. During oral arguments on July 31, judges were skeptical of the government's claim of broad tariff authority and indicated they might support the challenge brought by a group of small businesses and a coalition of Democratic-led states. Several cabinet members stated that invalidating the tariffs would overturn results achieved through months of negotiations with the European Union, Japan, South Korea, and others. Besent said, "Suspending the effect of the tariffs puts the United States at risk of retaliation from other countries, as they would see the U.S. as lacking the ability to respond quickly to retaliation."
